1. Acceptance of Terms

By accessing or using Prudence Thirty (the "Service"), a software-as-a-service application provided by Green Fire Software, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to update or modify these Terms at any time, with notice provided via the Service or email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

2. Eligibility

To use the Service, you must:

  • Be at least 13 years of age.
  • Provide your true and accurate birthdate during signup, as required for age verification in compliance with the Children’s Online Privacy Protection Act (COPPA).
  • If under 18, have parental or guardian consent to use the Service where required by law.

By signing up, you represent and warrant that you meet these eligibility requirements and that all information provided, including your birthdate, is accurate.

3. Service Description

Prudence Thirty is a web-based application designed to assist users in overcoming pornography addiction through a gamified tracking system, daily scores, streak tracking, and premium features (e.g., analytics, rewards). The Service is offered in Free and Pro tiers, with an Early Access Forerunner Pack available until the end of the Early Access period. We do not guarantee any specific outcomes, results, or benefits from using the Service, including but not limited to achieving abstinence or personal recovery goals.

4. User Accounts

  • Registration: You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to update such information as needed.
  • Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access or use.
  • Termination: We reserve the right to suspend or terminate your account for violation of these Terms, including providing false information or engaging in prohibited conduct.

5. Subscription and Payments

5.1 Subscription Tiers

  • Free Tier: Available to all users, with access to core features (e.g., daily score tracking, streak tracking).
  • Pro Tier: Available for $9.99/month or $89.99/year (or $4.99/month or $44.99/year for Forerunner Pack holders with a 50% discount). Includes premium features such as advanced analytics and exclusive rewards.
  • Forerunner Pack: A one-time purchase of $49.99 during Early Access (March 24, 2026 – end of the Early Access period), providing a 1-year Pro membership, a permanent 50% discount on future Pro plans, and exclusive rewards (e.g., Forerunner Outfit, badge).
  • Age-Based Access:
    • Users aged 13–17 receive free Pro access without payment requirements.
    • Users aged 18+ receive a 30-day Pro trial, after which they revert to the Free tier unless subscribed.

5.2 Payment Processing

  • Payments are processed securely via Stripe, a third-party payment processor. No payment card information is stored on our servers, ensuring compliance with PCI DSS standards.
  • Automatic Payments:
    • Monthly subscriptions renew on the same day each month. If a month lacks sufficient days (e.g., February), payment occurs on the last day of the month.
    • Annual subscriptions renew on the same day each year.
  • You authorize us to charge your payment method automatically for recurring subscriptions unless canceled.

5.3 Refunds

  • You may request a refund within 7 days of an automatic payment (monthly or annual) by contacting support@prudence30.com.
  • After 7 days, you are responsible for the cost of the portion of the subscription period used (e.g., pro-rated for monthly subscriptions, or full months used for annual subscriptions).
  • The Forerunner Pack ($49.99) is non-refundable, except as required by applicable law.

5.4 Subscription Cancellation

  • You may cancel your subscription at any time via your account settings or by contacting support@prudence30.com.
  • Upon cancellation, you will retain Pro access until the end of the current billing period, after which you revert to the Free tier.
  • Forerunner Pack benefits (e.g., 50% discount, exclusive rewards) remain active even after cancellation of recurring subscriptions.

6. User Data and Privacy

  • Data Usage: By using the Service, you consent to the collection, use, and storage of your data as outlined in our Privacy Policy. You further agree that we may use your data in anonymized, aggregated form to generate global data (e.g., fail rates for streak days) to improve the Service and provide insights to all users.
  • Data Requests: You may request the export or deletion of your personal data by contacting support@prudence30.com. We will comply with such requests within 30 days, subject to legal obligations.
  • Data Security: We implement industry-standard measures (e.g., AES-256 encryption at rest, TLS 1.3 in transit) to protect your data, but no system is completely secure. You acknowledge the inherent risks of providing information online.

7. Intellectual Property

  • Ownership: All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the exclusive property of Green Fire Software, Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws.
  • License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms.
  • User Content: You retain ownership of any data or content you submit to the Service (e.g., daily scores). By submitting content, you grant us a worldwide, royalty-free, non-exclusive license to use, store, and process it as described in these Terms and the Privacy Policy.

8. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Attempt to access, modify, or interfere with the Service’s systems, databases, or other users’ data.
  • Create multiple accounts to bypass restrictions or exploit features (e.g., trials).
  • Share, sell, or transfer your account or rewards (e.g., Forerunner Outfit) to others.
  • Use automated tools (e.g., bots, scrapers) to interact with the Service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or effective in achieving any specific outcome, including recovery from addiction.

10. Limitation of Liability

To the fullest extent permitted by law, Green Fire Software, Inc., its affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or other intangible losses, arising from or related to your use of the Service, even if advised of the possibility of such damages. Your sole remedy for dissatisfaction with the Service is to discontinue use.

11. Arbitration

  • Agreement to Arbitrate: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Philadelphia, Pennsylvania, unless otherwise agreed.
  • Procedure: Arbitration shall be conducted by a single arbitrator. The arbitrator’s decision is final and binding. Each party shall bear its own costs and attorney’s fees, except as required by law.
  • Class Action Waiver: You agree to resolve disputes on an individual basis. Class actions, class arbitrations, or representative actions are expressly waived.
  • Exceptions: Claims for injunctive relief or intellectual property violations may be brought in a court of competent jurisdiction.

12. Termination

  • By You: You may terminate your account at any time by contacting support@prudence30.com or using the account deletion feature.
  • By Us: We may terminate or suspend your access to the Service at our discretion, with or without cause, including for violation of these Terms, with notice provided where feasible.
  • Effect of Termination: Upon termination, your access to the Service ceases, and we may delete your data, subject to our Privacy Policy and legal obligations.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Pennsylvania, without regard to its conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Philadelphia, Pennsylvania.

14. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Green Fire Software, Inc. regarding the Service.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms at our discretion.
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver of such right or provision.
  • Force Majeure: We are not liable for delays or failures in performance due to events beyond our reasonable control (e.g., natural disasters, cyberattacks).
